While the current way many countries treat space works now this may not always be the case. Space colonies may not stay scientific forever. Eventually governments and company may want resources currently in space and not scientific colonies may develop. Once we hit the point at which colonizing other star systems becomes viable, as well as building makeshift space stations everywhere - the question will become fairly obsolete, as anyone who can afford a cheap spaceship will be able to claim land virtually anywhere.
